THE FOLLOWING CONTEST IS INTENDED FOR VIEWING IN THE UNITED STATES ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT PROCEED IN THIS SITE IF YOU ARE NOT A LEGAL U.S. RESIDENT LOCATED IN THE UNITED STATES.

NO PURCHASE NECESSARY

The Contest will be conducted each quarter beginning October, 2002. Each quarterly contest period (January-March, April-June, July-September, October-December) will begin on the first day of the quarter and end on the last day of the quarter. One prize will be awarded each quarter, based on entries received for each quarterly contest period. The Contest is open to legal residents of the 50 United States and D.C. 18 years of age or older, except employees of Diamonds International®, its parent company, affiliates, subsidiaries, distributors, sales representatives, retailers, advertising and promotion agencies, and the members of the immediate families or households of each of the above. Void outside the 50 United States and D.C. and where prohibited by law.

HOW TO ENTER

Create an original color photograph during your vacation in the Caribbean. You may submit your photo to enter the Contest in either of the following ways:

A. To enter by postal mail, download, print, and complete the official entry form with all requested information. Attach your photo entry to the entry form and mail in an appropriate envelope to: DI Photo Contest, 38 West 48 St., Third Floor, New York, NY 10036. Entry must be postmarked by the last day of the quarter in which you wish your entry to be judged. Limit one entry per envelope;

B. To enter online, complete the official entry form with all requested information at any time during a quarterly contest period. Attach your color photo entry in digital form (JPGs only, 50K limit per image) by following the on-screen instructions to submit your entry. Limit one entry per online submission. On-line entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is defined as the natural person who is assigned to the e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. On-line entries must be received by 11:59 p.m. EST on the last day of each quarter to be included in that quarter's judging.

All entries become the property of the Sponsor and will not be returned. Regardless of method of entry, you may submit no more than a total of 10 entries in any quarterly contest period. Each entry must be different and submitted separately. Sponsor assumes no responsibility for lost, late, damaged, misdirected, illegible, incomplete or postage-due mail or entries, or for computer system, hardware, software, network, program or other damage, errors or failures of any kind, whether human or technical in nature, that may arise from or in connection with participation in this contest, or in the transmission or receipt of on-line entries. All entries received become the Sponsor's property and will not be returned.

JUDGING

All entries received in each quarterly contest period will be judged by qualified judges based on the following criteria: Quality 50%; Content 50%. Judging will be conducted following the conclusion of each quarterly contest period. In the event of a tie, tied entrants must compete in a skill-based tie-breaker. For WI residents only, in case of a tie, duplicate prizes will be awarded. The decisions of the judges will be final in all matters relating to this contest.

PRIZE

One (1) Grand Prize Winner will be selected for each quarterly contest period. Each quarter's Grand Prize winning entry may, at the sponsor's discretion, be featured on the Diamonds International Web Site, and each Grand Prize winner will receive a $500 Diamonds International gift certificate redeemable on-line or at any Diamonds International store. Approximate retail value ("ARV") $500 each. (Grand Prize winners who entered by mail may be asked to submit a negative or slide of their entry so that there is no loss of quality if the photo is featured on the Sponsor's web site.)

WINNERS

Winners will be notified via telephone, postal mail or e-mail, and will be required to sign and return an affidavit of eligibility and liability/publicity release (where permitted) within 10 days of notification or prize may be forfeited and awarded to an alternate winner on the basis of the criteria set forth herein. Any person pictured in a winning or honorable mention photo, besides entrant, will be required to sign a liability/publicity release. Except where prohibited, acceptance of a prize constitutes winner's/ honorable mention's consent (or that of his/her parent or guardian if winner or honorable mention is a minor) to use winner's/ honorable mention's name, likeness and biographical data for advertising and promotional purposes worldwide without limitation and without additional compensation.

RIGHTS

Contest is subject to all applicable federal, state and local laws and regulations. Sponsor reserves the right, in its sole discretion, to cancel or suspend this contest should virus, bugs or other causes beyond Sponsor's control corrupt the administration, security or proper play of the contest. In the event of cancellation, winners will be selected from among all valid entries received prior to the time of cancellation. If a prize is won by a minor, it may be awarded in minor's name to a parent or legal guardian, who must sign all required documents. Submission of an entry grants Sponsor the right to use, publish, adapt, edit and/or modify such entry in any way, in any and all media worldwide, without limitation or compensation to the entrant. Submission of an entry further constitutes the entrant's consent to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in and to the entry, including but not limited to all intellectual property rights. Entries: must be the original work of the entrants; must be entrants' property; must not have won previous prizes; must not have been published previously; must not infringe any third-party rights; and must not be obscene or indecent in the opinion of the judges.

TRANSFER OF PRIZES

Prizes are non-transferable and may not be substituted except by Sponsor, who may substitute a prize of equal or greater value if an advertised prize becomes unavailable. All taxes on prizes are the responsibility of the winners/ honorable mentions.
